Foreigners in the State of Colima / Opinion of Blanca Torres. Legal Investigation.

The human being is always in constant challenge with himself, this implies that if his purpose is to travel, know or live in another country, they propose to him until he achieves it. The reasons why a person is in another territory, always directs to personal growth either for business, to enjoy and know the culture of that country and its people or to study in it.

The person who comes from another country that is not his own of origin, according to the RAE (2020) is referred to as a foreigner, so he lacks the qualities that prove him as originating therein; but it can acquire nationality whether the person was born there or by naturalization, which that country grants him rights and in turn forces him as others who are originally from there, to comply with the laws among other matters. In Colima, the la Secretaría de Relaciones Exteriores grants the naturalization letter according to requirements fulfilled or for marrying a Mexican.

And being this the cause in which you want to conclude the marriage contract between foreign (a) and Mexican (a), you must comply with the authorization by the Secretaría de Gobernación, so the Registro Civil will issue an inscription of that legal act in the Registro Nacional de Extranjeros and in the event that it does not have such certification by this Secretaría in question, the celebration cannot be carried out, being the only exception that the law has indicated the registration of birth or death certificate.

In our State legislation, every person who is living, visiting, studying in our State of Colima has the right to be recognized for their legal personality and enjoys the human rights embodied in our Magna Carta and Tratados Internacionales ratified by Mexico.

Foreign persons have rights and obligations like any national person, among some restrictions are to acquire immovable property within certain areas of the national territory or certain stock or financial transactions, one of the obligations are to keep and protect their immigration documentation to prove their situation in the country and if required by the authority, they must provide them with the information and show them what is asked of them.

Our civil legislation in the State of Colima applies without distinction to any person who is within the territory whether male or female, so their legal capacity are equal for all, so no one is subjected, dominated or dependent on another person and much less will have privileges above the other in exercising their rights.
